Whitehaven wins court battle

Coal miner defends injunction application from environment group that would have delayed construction works.

Whitehaven Coal (WHC) has won a court battle with an environment group that wanted to prevent the miner starting work on its Maules Creek project until another court judgement was finalised.

In a statement, Whitehaven said the Federal Court dismissed an application brought by the Northern Inland Council for the Environment seeking an injunction to stop the commencement of construction works at the mine.

The council wanted to halt construction before judgment was handed down in a separate case challenging the validity of the mine's approval under the Federal Environment Protection and Biodiversity Conservation Act. 

Whitehaven chief executive officer Paul Flynn said coal production remains on target for the first quarter of calendar year 2015.
